Under the guidance for determining and managing expenses for hiring foreign consultants for construction projects in Vietnam provided by the Construction Ministry in Circular No. 09/2007/TT-BXD of November 2, and based on specific conditions of investment projects, such expenses may be estimated in the total investment capital or budgets of such projects according to the costs of various types of consultancy work for similar construction projects already performed by foreign consultants, or to a percentage of total construction and equipment expenses, or to unit cost of an area (or population) unit of construction planning schemes.
The selection of foreign consultants must comply with the provisions of the bidding law and be made under contract between investors or agencies organizing the elaboration of construction planning and design and foreign consultancy contractors. Apart from necessary contents specified by legal provisions on contracts, such a contract must clearly state the number of months per consultant (or days or hours per consultant), professional qualifications of consultants, expected progress and results of consultancy.
Fees for hiring foreign consultants are determined through negotiations between investors or agencies organizing the elaboration of design and foreign consultancy contractors.-
