From June 25, employers listing sacked employees and setting wage scales and labor norms for their employees without reaching agreement with grassroots Trade Union leaders will be fined between VND 300,000 and 3 million.
Enterprises that delay or refuse to pay wages to employees who are medically treated for labor accidents will be fined between VND 2-10 million.
Employers failing to pay or fully pay severance allowances to sacked employees or collecting job placement charges higher than prescribed levels may be fined between VND 200,000 and 30 million.
New fine levels are provided in Government Decree No. 47/2010/ND-CP of May 6, which replaces Decree No. 113/2004/ND-CP of April 16, 2004, and does not address violations in job training, sending of guest workers under contracts and social insurance.
Failure to sign or improper signing of labor contracts will be fined up to VND 10 million.
An employee going on strike after a strike postponement or termination decision is issued by the Prime Minister will face a max fine of VND 2 million. This fine level will be applied to employees causing damage to machines, equipment and assets of their enterprises.
The heaviest fine of between VND 15-30 million will be imposed on impediment to the right to strike or revenge taken on strike goers.-
