Electronic monitoring and entry ban to be included in the Penal Code
Vietnam is set to introduce electronic monitoring and entry bans as new forms of additional penalties for criminal offenders, according to draft amendments to the 2015 Penal Code prepared by the Ministry of Public Security.

Vietnam is set to introduce electronic monitoring and entry bans as new forms of additional penalties for criminal offenders, according to draft amendments to the 2015 Penal Code prepared by the Ministry of Public Security.

These penalties are stipulated in two new articles of the Code, namely Articles 45a and 45b.

Accordingly, the penalty of an entry ban would be imposed on foreign nationals convicted of crimes.

Meanwhile, electronic monitoring would be applied to individuals convicted of certain offenses and subject to probation, prohibition of residence, or those sentenced to imprisonment but granted a suspended sentence or conditional early release. Applicable offenses include: offenses against human dignity or honor; infliction of injury or harm to others’ health; causing public disorder; illegal vehicle racing; drug-related crimes; ill-treatment or abuse of one’s grandparents, parents, spouse, children, grandchildren, or fosterers; and resistance or opposition to the people’s administration.

Electronic monitoring may also be applied to individuals convicted of offenses not listed above while serving their principal or additional penalties, or while granted conditional early release, depending on the nature and severity of the offenses.

Persons subject to electronic monitoring would be required to wear electronic tracking devices throughout the monitoring period. This duration corresponds to the period of serving the sentence of probation, prohibition of residence, or the probation period for those granted suspended sentences or conditional early release.- (VLLF)
