Important revisions of Security Guard Force Law

The National Assembly has recently passed the Law revising the 2017 Law on Security Guard Force (the Law) with the aim of building a regular, elite and modern security guard force up to international standards.

Under the new Law, three groups of subjects that require to be protected by official security guards include holders of key and high-ranking posts and title of the Communist Party of Vietnam, State of the Socialist Republic of Vietnam and Central Committee of the Vietnam Fatherland Front and international visitors who are counterparts of the above post and title holders and visit and work in the country; strategic areas, and particularly important events.

For persons and entities that are not entitled to security-guard protection in accordance with the Law, the Minister of Public Security may decide on application of professional measures, including also security guard measures to protect the national security and ensure social order and safety.

When necessary, the Minister of Public Security may decide to form security guard forces as units/divisions of provincial-level Public Security Departments in a flexible and practical manner so as not to increase the state payrolls for the public security sector.

The new Law allows the domestic security guard force to hire foreign security guards, vehicles and technical equipment to serve the security guard for key leaders of the Party and the State of Vietnam during their overseas visits.

Funds for hiring foreign security guards, vehicles and technical equipment come from the state budget. Standards, conditions, processes, norms and payment of expenses for hiring foreign security guards, vehicles and technical equipment must comply with laws of host countries and laws of Vietnam.

This Law is scheduled to come into force from the beginning of 2025.- (VLLF)
