Law revising four laws aims to simplify procedures for project implementation

The National Assembly on November 29 passed the Law Amending a Number of Articles of the Planning Law, Law on Investment, Law on Investment in the Form of Public-Private Partnership, and Bidding Law.

The omnibus Law revises 119 articles and clauses and three appendices of the four above-mentioned laws. It removes specific and detailed provisions falling within the Government’s competence so as to facilitate the decentralization and delegation of power to subordinate authorities, meeting the requirements for administrative reform and ensuring the conformity with reality.

Amendments to the Bidding Law give changes in the application of the Bidding Law to projects funded with ODA loans and concessional loans. It states that before concluding treaties or foreign loan agreements that contain provisions on bidding different from those provided in, or not stipulated by, the revising Law, agencies in charge of negotiation must send reports thereon to the Government for consideration and decision on the application of such treaties or agreements according to regulations of donors or international organizations of which Vietnam is a member. Under the Bidding Law, such reports must be submitted to the National Assembly Standing Committee. This is expected to facilitate capital mobilization and settlement of bidding-related problems.

The amending Law also increases the value threshold of bidding packages subject to contractor appointment from VND 100 million to VND 300 million, for bidding packages with procurement estimates not requiring project formulation. Particularly, the value threshold of bidding packages subject to contractor appointment is the same for bidding packages using funds for recurrent expenditures and those using public investment capital. It adds cases subject to contractor appointment for bidding packages of archaeological excavation, or restoration of national relics, special national relics and world cultural heritage.- (VLLF)
