The Ministry of Science and Technology has released a draft decree guiding the Law on Technology Transfer, focusing on improving support mechanisms for entities participating in technology transfer activities, particularly transferees of technologies transferred from science and technology organisations.
Under the draft, to receive support, enterprises must implement projects in sectors or trades or located in areas entitled to investment incentives in accordance with the investment law. They would also have to enter into technology transfer contracts or possess technology transfer registration certificates in case the registration is mandatory. Transferred technologies must be directly associated with projects in such support-eligible sectors, trades or areas.
Support would be provided in various forms, including interest rate subsidies on loans used to carry out technology transfer, or financial assistance through the performance of science, technology and innovation tasks. Enterprises might also receive direct support for developing innovation systems and innovative startup ecosystems, and promoting an innovation-driven culture.
In addition, enterprises would be prioritised for inclusion in lists of tasks subject to public selection or direct assignment of science, technology and innovation tasks, and receive support in accordance with the regulations of relevant programmes and funds for performance of such science, technology and innovation tasks. They might also receive support in hiring expert consultants for assessing and fine-tuning equipment, technological processes and production lines, or organising training and refresher courses to improve their capacity to absorb and master transferred technologies.
Funding for these support measures would be mobilised through the National Technology Innovation Fund, science, technology and innovation development funds of ministries, sectors and localities, along with other lawful sources.
The draft decree also provides support for organisations and enterprises involved in technology transfer activities, including enterprises, research institutes, educational institutions, and organisations owning technologies. Science and technology organisations, as well as intermediary organisations engaged in consultancy, brokerage, promotion and support for technology transfer would also be eligible for support.
According to the draft, technology transfer is identified as a priority area for which the State’s financial mechanisms for science, technology and innovation would be applied. Support would focus on the performance of science, technology and innovation tasks, and such activities as consultancy, brokerage, promotion, supply-demand linkage, evaluation, appraisal and training, would not include direct assistance for enterprises’ production or business activities.- (VLLF)
