Set to come into force from July 1 next year, the 2024 Law on the National Defense and Security Industry and Industrial Mobilization introduces a range of novel provisions on investment and production activities serving the national defense and security industry.
As per the Law, programs and projects in the field of national defense and security industry will be entitled to receive physical and financial resources and be included in medium-term and annual public investment plans.
Specifically, the Law says that the form of contractor appointment will apply to bidding packages in investment and procurement programs or projects that contain information classified as top secrets or strictly confidential information in accordance with the bidding law.
For programs and projects on research and production of weapons and technical equipment of strategic significance and special technical means, the order and procedures for making investment decision for emergency public investment projects specified in the Law on Public Investment will apply.
With regard to procurement of sample products, supplies, and specialized semi-finished products serving production activities in the field of national defense and security, it is allowed to appoint suppliers and apply the form of price negotiation under the regulations of the Ministry of National Defense and Ministry of Public Security.
Meanwhile, for investment projects involving the transfer of technologies from abroad to serve the national defense and security industry, the Law permits negotiation and signing of contracts with foreign partners in the stage of investment policy approval for use as a basis for project appraisal and approval.- (VLLF)
