New regulation on land border areas

The Prime Minister on April 29 issued Decree No. 34/2014/ND-CP, promulgating the Regulation on land border areas of the Socialist Republic of Vietnam.

Accordingly, border-area residents include people residing in border areas, people permitted by competent public security agencies to reside in the land border areas, and commissioned and non-commissioned officers, technical workers, public employees or civil servants, and soldiers of the People Army and the People’s Public Security garrisoned in the land border areas

Under the new regulation, Vietnamese citizens entering land border areas must submit identity cards or personal identification papers.

Foreigners permanently or temporarily residing in Vietnamese land border areas must be permitted by the provincial-level Public Security Departments of the localities where they reside or the Public Security Departments of the border provinces.

Vietnamese agencies or organizations taking foreigners into border areas must submit letters of introduction of the governing agencies/organizations and must inform at least 24 hours in advance to the Public Security Departments or the Border-Guard Command Posts of the border provinces.

In case of staying overnight, Vietnamese citizens and foreigners must register for stay with the commune-level Public Security Offices.

Peoples and means staying and operating in the border areas must possess adequate papers as required by law and be subject to the guidance, examination and control by the border-guard posts or commune-level public security forces.

The Decree also requires projects or sites constructed in border areas neither to affect borderlines and landmarks thereon nor violate agreements on border regulations which Vietnam has signed with bordering countries.-
