RESOLUTION No. 59/2007/NQ-CP:
Measures to tackle problems in construction investment

In order to put an end to the problematic state of investment and capital construction projects, including slow disbursement and low efficiency of capital, and especially in projects invested with state budget funds, investment credits and government bonds, the Government issued Resolution No. 59/2007/NQ-CP on November 30, providing measures to solve problems in construction investment and reform of administrative procedures applicable to enterprises.

Investors in projects are entitled to advances for payment of compensation for ground clearance upon the request of district-level boards for ground clearance compensation, support and resettlement and land fund development organizations.

The Government assigns the Ministry of Natural Resources and Environment to simplify procedures for granting mineral exploration and exploitation permission by integrating mineral survey with mineral exploration permits, and mineral processing with mineral exploitation. Investment certificates and consolidated permits may be granted at one time to enterprises.

The Ministry of Planning and Investment (MPI) is assigned to review and report the grant of investment certificates in recent periods to the Government and subsequently propose amendments to the Law on Investment to the National Assembly, in the direction of cancelling investment certificates for domestic projects or granting them for particular projects. For domestic construction projects funded with state capital, investment decisions or approvals of competent authorities can serve as investment certificates.

The Government also requires the MPI to promptly guide business registration and registration for tax identification numbers of enterprises within five working days, inclusion of business and tax identification number registration in the sole registration dossier set to be submitted to provincial/municipal Planning and Investment Services and consolidation of business registration codes and tax identification numbers into business codes. In the fourth quarter of 2008, it should complete the development of a national database on business registration and a wide-area network for information on and protection of enterprises’ names.

The Ministry of Public Security should in December guide procedures for carving seals of enterprises without seal-carving permits, and revise Decree No. 58/2001/ND-CP of August 24, 2001, on management and use of seals.-
