The Government has recently issued a decree detailing several provisions of the Law on the Digital Technology Industry, establishing specific criteria for identifying high-quality digital technology human resources in order to improve the legal framework for attracting and retaining talented people for digital technology development in Vietnam.
Effective as of the beginning of this year, Decree 353/2025/ND-CP provides criteria for identifying high-quality digital technology personnel across five specific groups.
Specifically, for personnel currently working at digital technology enterprises, the decree says that these persons will be regarded as high-quality human resources if they act as chairpersons of the Members’ Councils, chairpersons of the Boards of Directors, Chief Executive Officers, or holders of equivalent positions in the enterprises that have earned revenue of at least VND 26 trillion in one year during the last three years, according to announced financial statements.
In addition, these persons must be individuals directly engaged in digital technology industry activities if they: (i) have the average income from such activities over the last two years of at least five times the GDP per capita, for Vietnamese; (ii) have the average income from such activities over the last two years of at least three times the GDP per capita of the country where they work, for foreigners; or (iii) earn income at least five times the GDP per capita over the last two years in the country where they work, for foreigners not mentioned at Item (ii).
As for university graduates, eligible persons are those who have graduated within three years of completion and earned excellent degree or higher degree in digital technology or information technology-related fields from universities ranked among the top 500 universities worldwide by prestigious organisations such as Quacquarelli Symonds, Times Higher Education, Shanghai Ranking Consultancy, etc., or graduated with distinction degree or higher degree from the top 50 domestic institutions according to the list issued by Vietnam’s Ministry of Education and Training.
With respect to individuals working, teaching or conducting research at higher education institutions or research organisations, they will be considered high-quality personnel if holding senior academic or managerial positions, or equivalent positions at higher education institutions ranked among the top 500 universities worldwide as stated above, or possessing doctoral degree or higher degree and having at least three years of experience in teaching or research in digital technology or information technology at universities ranked among the top 500 degree worldwide.
For cadres, civil servants and public employees working in state agencies, qualified persons include those holding the post of heads of divisions of department-level agencies under ministries or provincial-level Departments who are directly involved in developing, managing or implementing policies related to digital technology and information technology.
The decree further recognises individuals with outstanding contributions to the digital technology sector as high-quality staff. These include researchers with recent scientific publications in Q1 journals indexed in Scopus or Web of Science, as well as authors or co-authors of at least one protected subject matter of intellectual property rights provided that such subject matters are digital technologies or digital technology products or services on the List of strategic technologies and strategic technology products approved by the Prime Minister, or the List of key digital technology products and services issued by the Minister of Science and Technology.- (VLLF)
