From May 1, the effective date of the 2023 Ordinance on Sanctioning of Administrative Violations in the Field of State Audit, the maximum fine to be imposed on an institutional violator is VND 100 million; for an individual violator, this level is half, i.e., VND 50 million.

The 21-article Ordinance provides for seven groups of acts of violation together with sanctioning forms and fines as well as remedial measures.

For each act of administrative violation in the field of state audit, an institutional or individual violator will be subject to either caution or fine as a principal sanction.

In case an organization or individual commits the same violation act, the fine level to be imposed on an organization is twice that to be imposed on an individual.

The two remedial measures specified in the Ordinance include forcible correction of false, inaccurate or untruthful information, documents and data; and forcible refund of illicit profit amounts (if any) earned from the commission of acts of administrative violation in the field of state audit.

The English version of the Ordinance is available on Official Gazette issues Nos 33-36 of 2023.- (VLLF)
